Cryptologic has, in an exclusive development for its Wagerlogic brand, launched Hold’em blackjack. Neteller concedes to Gambling Act

Payments processor Neteller has announced it will comply with the Unlawful Internet Gambling Act (UIEGA) and its related regulations “as if it were subject to the Act’s jurisdiction”.
It said the action was “intended to ensure that the company is able to continue to operate with the support of its principal commercial partners and to protect its shareholders, business partners, employees and reputation.”

The announcement is in contrast with previous noises from the company that suggested it would carry on business as usual.

The statement to the London Stock Exchange released on Thursday, 19 October, suggested that while there was some uncertainty regarding the obligations of financial transaction provider such as Neteller, this was likely to be “largely resolved” once the regulations are prescribed within 270 days.

The statement continued: “In view of the importance of these issues, Neteller has accelerated its review of the Act and all other relevant laws and pertinent developments. The company also continues to closely monitor the regulatory situation and is determining what actions to take well before the conclusion of the 270-day rulemaking period.”

In the interim, though, Neteller said non-US residents would be able to use the service as usual. “The funds of US-resident customers are held in trust accounts and will be available for withdrawal, on demand. The ability to withdraw funds will exist regardless of the customer’s location or ability to transfer to any site.”

It added that non-US customers were not affected by the legislative changes.

The statement concluded by saying Neteller remains “focused on developing its business in line with its stated strategic objectives including geographical and product diversification.”

As one of the oldest egaming domiciles with established legislation and a thriving financial centre, Curaçao has a great deal to offer

Curaçao has been one of the more overlooked egaming domiciles in recent years, but it has played a big part in the industry since the outset.

“The Netherlands Antilles was one of the earliest participants to provide gaming licences to qualified applicants,” Herman Behr, chief executive of e-management in Curaçao, says.

And with the rising importance attached to credibility in the egaming industry, Curaçao is rightly beginning to attract a lot of interest again.

As one of the five islands that makes up the Netherland Antilles, Curaçao lies off the coast of South America. Although famed for its calm sunny climate, Curaçao is not just a tourist Mecca: it has a long history as an established financial centre.

Financial strength

Curaçao has been the home of the Dutch offshore banking sector since the late 1930s, and is a major player in the international funds industry. As a result, the island has a skilled workforce and an absence from any international regulatory blacklist.

“Curaçao’s stability, sophistication and business environment provide all the required elements for a successful e-business,” Behr says.

It is also one of the few jurisdictions with respected egaming legislation in place. Operators seeking to use Curaçao as a base need either to apply directly to the government for a master licence, under The Offshore Games of Hazard Act, or for a sub-licence from an existing licensee. In the latter, more common, case the operator is designated by the licence-holder as an information provider.

The former route can take as long as six months, the latter as little as a few days. Applying for a sub-licence is not a rubber-stamp procedure, however, and there are still some strict guidelines to adhere to.

The basic procedure involves an application and submitting a business plan, various Know-Your-Client (KYC) documents and a wealth declaration form.

“All egaming operators, small or big, are welcome in Curaçao, provided they can comply with the strict KYC rules,” Behr says.

The legitimacy of its egaming operations is an integral part of Curaçao’s approach.

Legitimate operation

“Curaçao seeks to assure customers of the legality of internet gambling, the security of their business and legitimacy of their operation. Its strict adherence to complying with KYC rules, combined with absolute confidentiality has proven to be the key competitive edge as an international financial centre,” says Behr.

For those who pass the test, a favourable tax structure is waiting just off the South American coast. For companies granted an e-zone status, a formality for most egaming operators, there is a simple tax rate of 2% on net profits, and an exemption from all import duties and sales taxes.

To qualify, a company must be established in an economic zone area and direct its product offerings towards markets outside of the Netherlands Antilles. There are no additional taxes other than a monthly gaming licence fee, which varies depending on whether the owner is a master or sub-licensee.

Top-tier telecoms

The telecoms infrastructure compares favourably with the competition, with Curaçao offering safe, reliable, 24/7 hosting and a state-of-the-art expandable fibre-optic network.

This is due to the domicile’s well-developed e-commerce sector and a deregulated telecom market.

“Brand new fibre-optic networks such as Arcos and Americas II put Curaçao on the map for the profitable online companies,” Behr says.

“They are environmentally controlled and in addition to the secure facilities, uninterrupted power supplies, 24/7 monitoring and substantial bandwidth, Curaçao has everything you need to meet your web-hosting needs.”

Behr insists the government is committed to the future of the egaming industry, and will continue to build its infrastructure to cope with cross-border information, products, and taxation. But whatever happens in the future, there is no doubt Curaçao has a great deal to offer any egaming operator.

“Curaçao is an attractive solution,” Behr says. “Unlike many other domiciles we can offer the synergy between the available technological infrastructure and the long-standing experience as a financial centre.”

And as that level of credibility becomes more of a factor for new operator’s when selecting a domicile, Curaçao may be the one to watch once more.

Market entrance become a fall of 888.com

888.com turned into the newest online gambling company to drift on the stock market yesterday, though fears that enlargement in the sector is on the decrease dampened its debut.

Select States Cut Off From Online Poker Room

Vip.com online poker room has picked out specific states in America and said they won’t be able to play on the site in response to the new law recently signed into being by President Bush. Michigan, Illinois, Louisiana, Oregon, Wisconsin, Washington, Indiana, Nevada, New York, New Jersey, and South Dakota are the states, and residents in those eleven places will not be able to reach VIP.com poker site. These specific states have legislation that bans online gambling. This along with the new law is a strong enough situation to call for Microgaming to shut down access.

Research and Thinking about Unlawful Internet Gambling Enforcement Act

In the past couple of days, I’ve been dong a bit of research and thinking. However limited my thinking may be on a subject upon which I am notoriously biased… I’ve been trying to come up with a solution, one way or the other. Not there yet.

Wouldn’t any enforcement be subject to the claim of discriminatory enforcement? That is, enforcing restrictions against one sort of entity and not another? For example, every casino has many many ATM and credit card machines placed there for the precise purpose of getting money to gamble. The banks of origin of the various cards are often out-of-state, as are the folks using them. There seems to be little or no difference between getting money to use at a legal casino in, say, Nevada and getting money to use at a legal online gaming site based in, say, Antigua. There is still the interstate/iinternational access to money. Taking this argument to its logical extension, it would also be illegal to accept money for betting that has crossed interstate lines in any fashion. It starts getting absurd. If one further extends this rationale to lotteries, state paramutuel betting, etc., it becomes untenable.

The key seems to be to educate a majority of Congressmen and Senators. First of all, educate them to understand that poker is not a problem activity. It is entertainment, and, for some, a livelihood. It is no more subject to abuse (and is no doubt much less subject to abuse) than alcohol and smoking, and is far less damaging to health and welfare. Rather than an “immoral” enterprise, it can be entrepreneurial and invigorating. A game of skill, played against other players, not against house odds. A game one can study for and improve upon one’s skills. They need to rethink the “immorality” issue. We cannot let them continue to go with the easy knee-jerk reaction that poker must be bad.

Then educate them about the revenues involved. In a country that has been adding to the national debt by leaps and bounds, online poker has the potential, if licensed, regulated and taxed, to be a terrific source of revenue. Perhaps it would be possible to simply permit already existing casinos and similar state-owned enterprises to link through to online sites, thus permitting their citizens to enjoy the great game of poker while, at the same time, substantially increasing monies coming into the state through licensing/taxing.

Finally educate them that regulation, not criminalization, is the key to avoiding money-laudering, fraud and preventing children from playing poker. Regulation and cooperation could help the police locate any terrorist and criminals who might be trying to launder money through such venues. Criminalization leads to subterfuge; regulation leads to openness.

The bill may be on its way to being signed into law. But laws can change. They can be revised, rewritten, rethought, overturned as knee-jerk reactions give way to a more considered approach.

Crypto moves its revenue base to European markets

Egaming software developer CryptoLogic hailed its decision to shift its revenue base to European markets and has positioned itself for long-term profitability and growth, it said in a statement released this week.
CryptoLogic said it had been moving its business and revenue streams to Europe since 2001 and that it “spent five years preparing for this eventuality” since then.

CryptoLogic said it made over 70% of its revenues form outside the US and as of 30 June 2006 it had US$126m (£67m) on it s balance sheet and US$91.7m of working capital. It estimates the impact of the latest US regulatory changes will come to approximately US$30m for 2006 but maintained its objective of 20% corporate growth.

Lewis Rose, president and chief executive of CryptoLogic, said: “While the new US developments will be a challenge for the whole industry, our company’s diversification, strong balance sheet thriving European customers enable us to face the future with confidence.”

Rose said he believed the online gaming industry should be “regulated, licensed and taxed. We will continue to advocate regulation as the logical solution for all stakeholders, including players, investors and governments. In the meantime, we will continue to deepen our existing relationships and attract new customers in Europe, Asia and other thriving emerging markets”.

UIGE - payment processors respond

Payment processors on the whole have adopted a wait and see attitude towards the new US legislation.
FireOne said it was evaluating the situation and would update shareholders when appropriate. However, it said the act did “not define “unlawful internet gambling” nor does it make it unlawful “any activities by financial institutions that are not themselves gambling businesses”. But it expected the enactment of the act to have a significant negative impact on its business and results.

Neteller also said it was considering the impact of the act and would evaluate the situation as it develops and “that the Act may have a material adverse effect on Neteller’s US-facing business”. However, it added that once the US Federal Reserve and Attorney General had issued regulations “requiring each payment system and all participants therein to identify and block or otherwise prevent or prohibit restricted transactions”, it would “have a clearer view of which companies are affected, how those companies will be expected to comply and any possible resulting impact on the company”. Neteller said it focus on developing its “business in line with its stated strategic objectives includig geographical product diversification”.

IQ-Ludorum said it would review “its business activities and any impact on the from the proposed changes”. The company said it was too early to assess full impact of the legislation but expected it to “have an adverse effect on the group’s provision of gaming software and gaming-specific services”. IQ-Ludorum added that its flexible business should enable it to adapt to changing circumstances and that it had been working towards diversifying its portfolio. It said it would continue to monitor developments closely.

Recent Legislation

Monday brought a flood of action in response to the passage of Internet gaming legislation in the U. S. Congress late Friday evening. Some companies have come out already and stated that they will suspend American action from their sites (most notably PartyGaming and 888.com) while others have yet to decide what action to take. I was interested in the analysis of the issue from one of the finest legal minds on gambling when I contacted Professor I. Nelson Rose over the weekend.

Professor Rose is viewed as the foremost authority on gambling law. He has published several books on the subject, most notably his book from 1986 “Gambling and The Law”, and continues to write many articles regarding the subject. He also is a professor of law at Whittier Law School in California and has been involved both civil and criminal legal cases regarding gaming on both personal and industry wide levels. His views regarding the passage of the bill were quite eye opening and his thought processes very complete.

In an e-mail that I received from Professor Rose, he first took on the methods through which the bill was passed. “Would-be presidential candidate Sen. Bill Frist warped the law-making process to score a few points with his right-wing religious base,” he stated in the opening of our conversation. Professor Rose quickly moved on to his analysis of the bill by remarking, “The new law will be difficult to enforce. It only applies to “unlawful” gaming, but does not expand the reach of the main federal anti-gaming statute, the Wire Act. So, there are still going to be arguments that Internet poker, for example, is not unlawful.”

“The new crime on transferring money only applies to gambling businesses,” he continued. “Payment processors are not covered, unless prosecutors want to use theories of aiding and abetting. Treasury will make new regulations to require money transferors to identify and block funds from gambling sites. Banks will thus not be required to read paper checks.”

When looking at offshore payment processing houses, Professor Rose pointed out a very important factor. “Why should NETeller comply with U.S. regulations? The U.S. and state Attorneys General can get court orders preventing ISPs from hosting sites that transfer money, but NETeller is not hosted by a U.S. server. Foreign nations are not usually required to enforce U.S. injunctions.”
